TUITION REIMBURSEMENT PROGRAM

Operating policies of the Complete Trader Program program:

The Complete Trader Program program is an onlineprogram, which consists of videos with teachings on trading given by Oliver Velez and translated into Spanish (from English), which are sent to the practitioner three days after making the payment of the amount charged by the program.

1.The Complete Trader Program program aims to provide trading education and to deliver the trading methodology applied by Oliver Velez. each person who acquires is responsible to learn, practice and apply it, since trading is a profession that consists of many personal variables, both psychological and trading techniques that the practitioner must acquire in their day-to-day practice. But it is not under Escuela de Capacitaciones’ control (hereinafter ifundtraders) that the practitioner has the discipline and perseverance necessary to acquire them.

The Complete Trader Program program makes available to the practitioner Oliver Velez’s knowledge of over 35 years of trading, as well as 90 days of access to a live trading room taught by traders who are part of Oliver Velez’s team of traders.

5.TRADING DEMO ACCOUNT. Each registered practitioner has the option of purchasing a demo trading account on the platform, which has a cost of $125 per month that will be deducted from a credit card that must be provided by the practitioner; If you decide to do so, you will be given a respective username and password in which you can practice your trading in the stock market from 8:30 a.m. to 4:00 p.m. New York time, Monday through Friday, the platform cannot be used outside of these days or hours, as well as it can not be used on United States’ holidays.

6.When carrying out the practice trades, the practitioner will have some limitations in his trading that Ifundtraders considers essential to forge character as a professional trader, which are mentioned below and that the trader accepts freely and voluntarily.

The practitioner can only trade the shares that are on the IFT100 list
It is traded in lots, each lot must contain a minimum of 100 shares and a maximum of 5 lots per trade can be traded as long as the value does not exceed its purchasing power.
Ifundtraders will determine a list of tradable stocks for the practitioner

Requirements for the new Sterling Platform, as of October 8, 2020

Our new risk management program will now be equipped with new functions regarding max loss per day and profit protection trailing stops. We will also be eliminating the max loss per week to make sure that traders can be able to trade every day of the week.

The new max loss per day will be $200 for all accounts with $50k buying power. And $350 for all the accounts with $100K buying power. As mentioned before, there will not be a max loss per week, this max loss per day will allow traders to trade the 5 days of the trading week and therefore have 5 days of practice. The auto liquidation will work the same as before if you reach the max loss per day.

The new profit protection trailing stop will work in the following manner:

For $50k accounts, once your open or closed profit reaches $100, Your daily stop will be moved to 0, meaning that you can no longer end the day in negative territory and if you lose those $100, your platform will be shut down as if you had reached the max loss per day. When you reach $200 in profit, your daily stop will be moved to $100 to make sure that you end up with profit for the day. You can continue to trade and look for more profit but your stop will remain at $100, from this point on you can decide how to manage your profit trailing stop.

The buying power will remain the same as the one you previously had, but the stocks that you can trade will no longer depend on the price, this means that you will be able to trade stocks with a price higher than $175 that are in the IFT50 list.

The amount of lots to trade for 50k accounts is still 5, this will depend on the price of the stock and the capacity of your buying power, if the price is too high, it might surpass your buying power.

The IFT 50 list will be implemented and these will be the stocks that will be available to trade for traders in development.

The requisites to gain access to a live account are still the same: “The Complete Trader Program program has an incentive for traders for the participants, which consists in being funded with a real trading account by Oliver Velez with a value of 50 thousand USD of buying power. La prestación del servicio de Portal por parte de IFUNDTRADERS es gratuito para los Usuarios y no exige la previa suscripción o registro del Usuario. No obstante, la utilización de algunos Servicios sólo puede hacerse mediante suscripción o registro del Usuario y/o pago de un precio, de la forma en que se indica expresamente en sus correspondientes Condiciones Particulares.

1.2.OBLIGACIÓN DE HACER UN USO CORRECTO DEL PORTAL Y DE LOS SERVICIOS

El Usuario se compromete a utilizar el Portal y los Servicios de conformidad con la ley, estas Condiciones Generales, así como con la moral, las buenas costumbres y el orden público.

6.EXCLUSIÓN DE GARANTÍAS Y DE RESPONSABILIDAD

6.1.EXCLUSIÓN DE GARANTÍAS Y DE RESPONSABILIDAD POR EL FUNCIONAMIENTO DEL PORTAL Y DE LOS SERVICIOS

Cuando ello sea posible, IFUNDTRADERS advertirá previamente las interrupciones en el funcionamiento del Portal y de los Servicios. IFUNDTRADERS tampoco garantiza la utilidad del Portal y de los Servicios para la realización de ninguna actividad en particular, ni su infalibilidad y, en particular, aunque no de modo exclusivo, que los Usuarios puedan efectivamente utilizar el Portal y los Servicios, acceder a las distintas páginas web que forman el Portal o a aquellas desde las que se prestan los Servicios.

IFUNDTRADERS EXCLUYE CUALQUIER RESPONSABILIDAD POR LOS DAÑOS Y PERJUICIOS DE TODA NATURALEZA QUE PUEDAN DEBERSE A LA FALTA DE DISPONIBILIDAD O DE CONTINUIDAD DEL FUNCIONAMIENTO DEL PORTAL Y DE LOS SERVICIOS, A LA DEFRAUDACIÓN DE LA UTILIDAD QUE LOS USUARIOS HUBIEREN PODIDO ATRIBUIR AL PORTAL Y A LOS SERVICIOS, A LA FALIBILIDAD DEL PORTAL Y DE LOS SERVICIOS, Y EN PARTICULAR, AUNQUE NO DE MODO EXCLUSIVO, A LOS FALLOS EN EL ACCESO A LAS DISTINTAS PÁGINAS WEB DEL PORTAL O A AQUELLAS DESDE LAS QUE SE PRESTAN LOS SERVICIOS.

6.1.2.PRIVACIDAD Y SEGURIDAD EN LA UTILIZACIÓN DEL PORTAL Y DE LOS SERVICIOS

IFUNDTRADERS no garantiza la privacidad y seguridad de la utilización del Portal y de los Servicios y, en particular, no garantiza que terceros no autorizados no puedan tener conocimiento de la clase, condiciones, características y circunstancias del uso que los Usuarios hacen del Portal y de los Servicios.

IFUNDTRADERS EXCLUYE TODA RESPONSABILIDAD POR LOS DAÑOS Y PERJUICIOS DE TODA NATURALEZA QUE PUDIERAN DEBERSE AL CONOCIMIENTO QUE PUEDAN TENER TERCEROS NO AUTORIZADOS DE LA CLASE, CONDICIONES, CARACTERÍSTICAS Y CIRCUNSTANCIAS DEL USO QUE LOS USUARIOS HACEN DEL PORTAL Y DE LOS SERVICIOS.

IFUNDTRADERS EXCLUYE CUALQUIER RESPONSABILIDAD POR LOS DAÑOS Y PERJUICIOS DE TODA NATURALEZA QUE PUEDAN DEBERSE A LA PRESENCIA DE VIRUS O A LA PRESENCIA DE OTROS ELEMENTOS EN LOS CONTENIDOS QUE PUEDAN PRODUCIR ALTERACIONES EN EL SISTEMA INFORMÁTICO, DOCUMENTOS ELECTRONICOS O FICHEROS DE LOS USUARIOS.

6.1.4.LICITUD, FIABILIDAD Y UTILIDAD

IFUNDTRADERS no garantiza la licitud, fiabilidad y utilidad de los contenidos.

IFUNDTRADERS excluye cualquier responsabilidad por los daños y perjuicios de toda naturaleza que puedan deberse a la transmisión, difusión, almacenamiento, puesta a disposición, recepción, obtención o acceso a los contenidos, y en particular, aunque no de modo exclusivo, por los daños y perjuicios que puedan deberse a (a) el incumplimiento de la ley, la moral y las buenas costumbres generalmente aceptadas o el orden público como consecuencia de la transmisión, difusión, almacenamiento, puesta a disposición, recepción, obtención o acceso a los contenidos; (b) la infracción de los derechos de propiedad intelectual e industrial, de los secretos empresariales, de compromisos contractuales de cualquier clase, de los derechos al honor, a la intimidad personal y familiar y a la imagen de las personas, de los derechos de propiedad y de toda otra naturaleza pertenecientes a un tercero como consecuencia de la transmisión, difusión, almacenamiento, puesta a disposición, recepción, obtención o acceso a los contenidos; (c) la realización de actos de competencia desleal y publicidad ilícita como consecuencia de la transmisión, difusión, almacenamiento, puesta a disposición, recepción, obtención o acceso a los contenidos; (d) la falta de veracidad, exactitud, exhaustividad, pertinencia y/o actualidad de los contenidos; (e) la inadecuación para cualquier clase de propósito de y la defraudación de las expectativas generadas por los contenidos; (f) el incumplimiento, retraso en el cumplimiento, cumplimiento defectuoso o terminación por cualquier causa de las obligaciones contraídas por terceros y contratos realizados con terceros a través de o con motivo del acceso a los contenidos; (g) los vicios y defectos de toda clase de los contenidos transmitidos, difundidos, almacenados, puestos a disposición o de otra forma transmitidos o puestos a disposición, recibidos, obtenidos o a los que se haya accedido a través del portal o de los servicios.

IFUNDTRADERS EXCLUYE CUALQUIER RESPONSABILIDAD POR LOS DAÑOS Y PERJUICIOS DE TODA NATURALEZA QUE PUEDAN DEBERSE A LOS SERVICIOS PRESTADOS POR TERCEROS A TRAVÉS DEL PORTAL, Y EN PARTICULAR, AUNQUE NO DE MODO EXCLUSIVO, POR LOS DAÑOS Y PERJUICIOS QUE PUEDAN DEBERSE A (A) EL INCUMPLIMIENTO DE LA LEY, LA MORAL Y LAS BUENAS COSTUMBRES GENERALMENTE ACEPTADAS O EL ORDEN PÚBLICO COMO CONSECUENCIA DE LA PRESTACIÓN DE SERVICIOS POR TERCEROS A TRAVÉS DEL PORTAL; (B) LA INFRACCIÓN DE LOS DERECHOS DE PROPIEDAD INTELECTUAL E INDUSTRIAL, DE LOS SECRETOS EMPRESARIALES, DE COMPROMISOS CONTRACTUALES DE CUALQUIER CLASE, DE LOS DERECHOS AL HONOR, A LA INTIMIDAD PERSONAL Y FAMILIAR Y A LA IMAGEN DE LAS PERSONAS, DE LOS DERECHOS DE PROPIEDAD Y DE TODA OTRA NATURALEZA PERTENECIENTES A UN TERCERO COMO CONSECUENCIA DE LA PRESTACIÓN DE SERVICIOS POR TERCEROS A TRAVÉS DEL PORTAL; (C) LA REALIZACIÓN DE ACTOS DE COMPETENCIA DESLEAL Y PUBLICIDAD ILÍCITA COMO CONSECUENCIA DE LA PRESTACIÓN DE SERVICIOS POR TERCEROS A TRAVÉS DEL PORTAL; (D) LA FALTA DE VERACIDAD, EXACTITUD, EXHAUSTIVIDAD, PERTINENCIA Y/O ACTUALIDAD DE LOS CONTENIDOS TRANSMITIDOS, DIFUNDIDOS, ALMACENADOS, RECIBIDOS, OBTENIDOS, PUESTOS A DISPOSICIÓN O ACCESIBLES MEDIANTE LOS SERVICIOS PRESTADOS POR TERCEROS A TRAVÉS DEL PORTAL; (E) LA INADECUACIÓN PARA CUALQUIER CLASE DE PROPÓSITO DE Y LA DEFRAUDACIÓN DE LAS EXPECTATIVAS GENERADAS POR LOS SERVICIOS PRESTADOS POR TERCEROS A TRAVÉS DEL PORTAL; (F) EL INCUMPLIMIENTO, RETRASO EN EL CUMPLIMIENTO, CUMPLIMIENTO DEFECTUOSO O TERMINACIÓN POR CUALQUIER CAUSA DE LAS OBLIGACIONES CONTRAÍDAS POR TERCEROS Y CONTRATOS REALIZADOS CON TERCEROS EN RELACIÓN CON O CON MOTIVO DE LA PRESTACIÓN DE SERVICIOS A TRAVÉS DEL PORTAL; (G) LOS VICIOS Y DEFECTOS DE TODA CLASE DE LOS SERVICIOS PRESTADOS POR TERCEROS A TRAVÉS DEL PORTAL.

6.1.6.EXCLUSIÓN DE GARANTÍAS Y DE RESPONSABILIDAD POR LOS SERVICIOS Y CONTENIDOS ALOJADOS FUERA DEL PORTAL

El Portal pone a disposición de los Usuarios dispositivos técnicos de enlace (tales como, entre otros, links, banners, botones), directorios y herramientas de búsqueda que permiten a los Usuarios acceder a sitios web pertenecientes a y/o gestionados por terceros (en adelante, “Sitios Enlazados”). El Usuario, por tanto, debe extremar la prudencia en la valoración y utilización de los servicios, información, datos, archivos, productos y cualquier clase de material existente en los Sitios Enlazados.

IFUNDTRADERS NO GARANTIZA NI ASUME NINGÚN TIPO DE RESPONSABILIDAD POR LOS DAÑOS Y PERJUICIOS DE TODA CLASE QUE PUEDAN DEBERSE A (A) EL FUNCIONAMIENTO, DISPONIBILIDAD, ACCESIBILIDAD O CONTINUIDAD DE LOS SITIOS ENLAZADOS; (B) EL MANTENIMIENTO DE LOS SERVICIOS, CONTENIDOS, INFORMACIÓN, DATOS, ARCHIVOS, PRODUCTOS Y CUALQUIER CLASE DE MATERIAL EXISTENTE EN LOS SITIOS ENLAZADOS; (C) LA PRESTACIÓN O TRANSMISIÓN DE LOS SERVICIOS, CONTENIDOS, INFORMACIÓN, DATOS, ARCHIVOS, PRODUCTOS Y CUALQUIER CLASE DE MATERIAL EXISTENTE EN LOS SITIOS ENLAZADOS; (D) LA CALIDAD, LICITUD, FIABILIDAD Y UTILIDAD DE LOS SERVICIOS, CONTENIDOS, INFORMACIÓN, DATOS, ARCHIVOS, PRODUCTOS Y CUALQUIER CLASE DE MATERIAL EXISTENTE EN LOS SITIOS ENLAZADOS, EN LOS MISMOS TÉRMINOS Y CON EL MISMO ALCANCE DISPUESTO EN LA CONDICIÓN GENERAL 0 Y 0 RESPECTO DE LOS CONTENIDOS Y DE LOS SERVICIOS PRESTADOS POR TERCEROS A TRAVÉS DEL PORTAL.

6.1.7.EXCLUSIÓN DE GARANTÍAS Y DE RESPONSABILIDAD POR LA UTILIZACIÓN DEL PORTAL, DE LOS SERVICIOS Y DE LOS CONTENIDOS POR LOS USUARIOS

IFUNDTRADERS no tiene obligación de y no controla la utilización que los Usuarios hacen del Portal, de los Servicios y de los Contenidos. En particular, IFUNDTRADERS no garantiza que los Usuarios utilicen el Portal, los Servicios y los Contenidos de conformidad con estas Condiciones Generales y, en su caso, las Condiciones Particulares que resulten de aplicación, ni que lo hagan de forma diligente y prudente. IFUNDTRADERS tampoco tiene la obligación de verificar y no verifica la identidad de los Usuarios, ni la veracidad, vigencia, exhaustividad y/o autenticidad de los datos que los Usuarios proporcionan sobre sí mismos a otros Usuarios.

IFUNDTRADERS EXCLUYE CUALQUIER RESPONSABILIDAD POR LOS DAÑOS Y PERJUICIOS DE TODA NATURALEZA QUE PUDIERAN DEBERSE A LA UTILIZACIÓN DE LOS SERVICIOS Y DE LOS CONTENIDOS POR PARTE DE LOS USUARIOS O QUE PUEDAN DEBERSE A LA FALTA DE VERACIDAD, VIGENCIA, EXHAUSTIVIDAD Y/O AUTENTICIDAD DE LA INFORMACIÓN QUE LOS USUARIOS PROPORCIONAN A OTROS USUARIOS ACERCA DE SÍ MISMOS Y, EN PARTICULAR, AUNQUE NO DE FORMA EXCLUSIVA, POR LOS DAÑOS Y PERJUICIOS DE TODA NATURALEZA QUE PUEDAN DEBERSE A LA SUPLANTACIÓN DE LA PERSONALIDAD DE UN TERCERO EFECTUADA POR UN USUARIO EN CUALQUIER CLASE DE COMUNICACIÓN REALIZADA A TRAVÉS DEL PORTAL.

7.NO LICENCIA

IFUNDTRADERS no concede ninguna licencia o autorización de uso de ninguna clase sobre sus derechos de propiedad industrial e intelectual o sobre cualquier otra propiedad o derecho relacionado con el Portal, los Servicios o los Contenidos.

8.DENEGACIÓN Y RETIRADA DEL ACCESO AL PORTAL Y/O A LOS SERVICIOS

IFUNDTRADERS se reserva el derecho a denegar o retirar el acceso al Portal y/o a los Servicios, en cualquier momento y sin necesidad de preaviso a aquellos Usuarios que incumplan estas Condiciones Generales o las Condiciones Particulares que resulten de aplicación.

11.DURACIÓN Y TERMINACIÓN

La prestación del servicio de Portal y de los demás Servicios tiene, en principio, una duración indefinida. IFUNDTRADERS, no obstante, está autorizada para dar por terminada o suspender la prestación del servicio del Portal y/o de cualquiera de los Servicios en cualquier momento, sin perjuicio de lo que se hubiere dispuesto al respecto en las correspondientes Condiciones Particulares. Cuando ello sea razonablemente posible, IFUNDTRADERS advertirá previamente la terminación o suspensión de la prestación del servicio de Portal y de los demás Servicios.

CONDIÇÕES GERAIS E SUA ACEITAÇÃO

A prestação do serviço do Portal pela IFUNDTRADERS é gratuita para os Usuários e não requer subscrição ou registro prévio por parte do Usuário. No entanto, a utilização de alguns Serviços só poderá ser feita através da subscrição ou registro do Usuário e/ou do pagamento de um preço, na forma expressamente indicada nas Condições Particulares correspondentes.

1.2. OBRIGAÇÃO DE UTILIZAR CORRECTAMENTE O PORTAL E OS SERVIÇOS

O Usuário compromete-se a utilizar o Portal e os Serviços de acordo com a lei, as presentes Condições Gerais, bem como com a moral, os bons costumes e a ordem pública.

O Usuário compromete-se a utilizar os Conteúdos de forma diligente, correta e lícita e, em particular, compromete-se a abster-se de (a) utilizar os Conteúdos de forma, para fins ou efeitos contrários à lei, à moral e aos bons costumes ou à ordem pública geralmente aceites; (b) reproduzir ou copiar, distribuir, permitir o acesso público através de qualquer forma de comunicação pública, transformar ou modificar os Conteúdos, salvo se tiver a autorização do titular dos direitos correspondentes ou se tal for legalmente permitido; (c) eliminar, iludir ou manipular os direitos de autor e outros dados que identifiquem os direitos de IFUNDTRADERS ou de seus titulares incorporados aos Conteúdos, bem como os dispositivos técnicos de proteção, impressões digitais ou quaisquer mecanismos de informação que possam conter os Conteúdos; (d) utilizar os Conteúdos e, em particular, a informação de qualquer tipo obtida através do Portal ou dos Serviços para enviar publicidade, comunicações para fins de venda direta ou para qualquer outro fim comercial, mensagens não solicitadas dirigidas a uma pluralidade de pessoas independentemente da sua finalidade, bem como para se abster de comercializar ou difundir de qualquer forma tal informação.

1.6. RESPONSABILIDADE POR DANOS

O Usuário será responsável por quaisquer danos de qualquer natureza que a IFundTraders possa sofrer, direta ou indiretamente, como resultado do descumprimento de qualquer uma das obrigações previstas nas Condições Gerais ou na lei em relação ao uso do Portal.

2.OBJETO

Através do Portal, a IFUNDTRADERS proporciona aos Usuários o acesso e a utilização dos diversos serviços e conteúdos disponibilizados aos Usuários pela IFUNDTRADERS ou por terceiros usuários do Portal e/ou terceiros provedores de serviços e conteúdo (doravante denominado «Serviços»).

A IFUNDTRADERS reserva-se o direito de modificar unilateralmente, a qualquer momento e sem aviso prévio, a apresentação e configuração do Portal, bem como os Serviços e as condições necessárias à utilização do Portal e dos Serviços.

3.DADOS PESSOAIS

Para utilizar alguns dos Serviços, o Usuário deverá fornecer previamente à IFUNDTRADERS determinados dados pessoais (doravante, os «Dados Pessoais»). A IFUNDTRADERS processará automaticamente os Dados Pessoais para os fins e nas condições definidas na sua Política de Proteção de Dados.

4.UTILIZAÇÃO DA TECNOLOGIA DE COOKIES

A IFUNDTRADERS utiliza cookies quando um Usuário navega pelos sites e páginas web do Portal. Os nossos cookies estão apenas associados a um Usuário anónimo e ao seu computador e não fornecem referências que permitam deduzir o nome e apelido do Usuário. Os cookies da IFUNDTRADERS não podem ler dados do seu disco rígido ou ler ficheiros cookie criados por outros fornecedores. IFUNDTRADERS codifica os dados de identificação do usuário para maior segurança. Graças aos cookies, é possível para a IFUNDTRADERS reconhecer Usuários registrados após o seu primeiro registro, sem que eles tenham que se registrar em cada visita para acessar as áreas e serviços reservados exclusivamente para eles. UTILIZAÇÃO DO PORTAL, SERVIÇOS E CONTEÚDOS SOB A EXCLUSIVA RESPONSABILIDADE DO USUÁRIO

Uso do Portal: o acesso a isto significa que você aceitou que seu uso deste Portal, seus Conteúdos e as informações nele contidas terão fins legítimos e legais, e serão feitos em conformidade com estes TERMOS E CONDIÇÕES e toda e qualquer lei aplicável, em qualquer caso, sob sua exclusiva responsabilidade. 6.EXCLUSÃO DE GARANTIAS E RESPONSABILIDADE

6.1. EXCLUSÃO DE GARANTIAS E RESPONSABILIDADE PELO FUNCIONAMENTO DO PORTAL E DOS SERVIÇOS

6.1.1. DISPONIBILIDADE E CONTINUIDADE, UTILIDADE E FALIBILIDADE

A IFUNDTRADERS não garante a disponibilidade e continuidade do funcionamento do Portal e dos Serviços. Sempre que possível, a IFUNDTRADERS deverá comunicar previamente quaisquer interrupções no funcionamento do Portal e dos Serviços. A IFUNDTRADERS também não garante a utilidade do Portal e dos Serviços para a realização de qualquer atividade em particular, nem a sua infalibilidade e, em particular, embora não exclusivamente, que os Usuários possam utilizar eficazmente o Portal e os Serviços, aceder às diferentes páginas web que compõem o Portal ou aquelas a partir das quais os Serviços são prestados.

A IFUNDTRADERS EXCLUI QUALQUER RESPONSABILIDADE POR DANOS E PREJUÍZOS DE QUALQUER NATUREZA QUE POSSAM DEVER-SE À FALTA DE DISPONIBILIDADE OU CONTINUIDADE DO FUNCIONAMENTO DO PORTAL E DOS SERVIÇOS, À DEFRAUDAÇÃO DA UTILIDADE QUE OS USUÁRIOS POSSAM TER ATRIBUÍDO AO PORTAL E AOS SERVIÇOS, À FALIBILIDADE DO PORTAL E DOS SERVIÇOS E, EM PARTICULAR, EMBORA NÃO EXCLUSIVAMENTE, A FALHAS NO ACESSO ÀS DIFERENTES PÁGINAS WEB DO PORTAL OU ÀQUELES A PARTIR DOS QUAIS OS SERVIÇOS SÃO PRESTADOS.

6.1.2. PRIVACIDADE E SEGURANÇA NA UTILIZAÇÃO DO PORTAL E DOS SERVIÇOS

A IFUNDTRADERS não garante a privacidade e segurança da utilização do Portal e dos Serviços e, em particular, não garante que terceiros não autorizados não tenham conhecimento do tipo, condições, características e circunstâncias da utilização que os Usuários fazem do Portal e dos Serviços.

A IFUNDTRADERS EXCLUI QUALQUER RESPONSABILIDADE POR DANOS DE QUALQUER NATUREZA QUE POSSAM DEVER-SE AO CONHECIMENTO QUE TERCEIROS NÃO AUTORIZADOS POSSAM TER DO TIPO, CONDIÇÕES, CARACTERÍSTICAS E CIRCUNSTÂNCIAS DO USO QUE OS USUÁRIOS FAZEM DO PORTAL E DOS SERVIÇOS.

6.1.3. EXCLUSÃO DE GARANTIAS E RESPONSABILIDADE PELO CONTEÚDO

A IFUNDTRADERS não controla nem garante a ausência de vírus ou outros elementos nos Conteúdos que possam produzir alterações no seu sistema informático (software e hardware) ou nos documentos electrónicos e ficheiros armazenados no seu sistema informático.

A IFUNDTRADERS EXCLUI QUALQUER RESPONSABILIDADE POR DANOS DE QUALQUER NATUREZA QUE POSSAM DEVER-SE À PRESENÇA DE VÍRUS OU À PRESENÇA DE OUTROS ELEMENTOS NOS CONTEÚDOS QUE POSSAM CAUSAR ALTERAÇÕES NO SISTEMA INFORMÁTICO, DOCUMENTOS ELECTRÓNICOS OU FICHEIROS DOS USUÁRIOS.

6.1.4. LEGALIDADE, FIABILIDADE E UTILIDADE

A IFUNDTRADERS não garante a legalidade, fiabilidade e utilidade dos conteúdos.

A IFUNDTRADERS exclui qualquer responsabilidade por danos e prejuízos de qualquer natureza que possam dever-se à transmissão, difusão, armazenamento, disponibilização, recepção, obtenção ou acesso aos conteúdos, e em particular, embora não exclusivamente, por danos e prejuízos que possam dever-se (a) ao incumprimento da lei, dos bons costumes e da ordem pública geralmente aceites como resultado da transmissão, difusão, armazenamento, disponibilização, recepção, obtenção ou acesso aos conteúdos; b) Violação dos direitos de propriedade intelectual e industrial, segredos comerciais, compromissos contratuais de qualquer tipo, direitos de honra, privacidade pessoal e familiar e imagem das pessoas, direitos de propriedade e de qualquer outra natureza pertencentes a terceiros em consequência da transmissão, difusão, armazenamento, disponibilização, recepção, obtenção ou acesso aos conteúdos; (c) a prática de atos de concorrência desleal e publicidade ilícita como consequência da transmissão, difusão, armazenamento, disponibilização, recepção, obtenção ou acesso aos conteúdos; (d) a falta de veracidade, exatidão, integridade, relevância e/ou atualidade dos conteúdos; (e) a inaptidão para qualquer tipo de finalidade e a desilusão das expectativas geradas pelos conteúdos; (f) incumprimento, atraso no cumprimento, cumprimento defeituoso ou rescisão por qualquer motivo de obrigações contraídas por terceiros e contratos celebrados com terceiros através ou por conta do acesso aos conteúdos; (g) vícios e defeitos de todo o tipo de conteúdo transmitidos, difundidos, armazenados, disponibilizados ou transmitidos ou disponibilizados de outra forma, recebidos, obtidos ou acedidos através do portal ou dos serviços.

A IFUNDTRADERS EXCLUI QUALQUER RESPONSABILIDADE POR DANOS DE QUALQUER NATUREZA QUE POSSAM DEVER-SE À PRESENÇA DE VÍRUS OU OUTROS ELEMENTOS NOCIVOS NOS SERVIÇOS PRESTADOS POR TERCEIROS ATRAVÉS DO PORTAL QUE POSSAM PROVOCAR ALTERAÇÕES NO SISTEMA INFORMÁTICO, DOCUMENTOS ELECTRÓNICOS OU FICHEIROS DOS USUÁRIOS.

6.1.5.2. LEGALIDADE, FIABILIDADE E UTILIDADE

A IFUNDTRADERS não garante a legalidade, confiabilidade e utilidade dos serviços prestados por terceiros através do Portal.

A IFUNDTRADERS EXCLUI QUALQUER RESPONSABILIDADE POR DANOS DE QUALQUER NATUREZA QUE POSSAM DEVER-SE A SERVIÇOS PRESTADOS POR TERCEIROS ATRAVÉS DO PORTAL, E EM PARTICULAR, EMBORA NÃO EXCLUSIVAMENTE, POR DANOS QUE POSSAM DEVER-SE A (A) INCUMPRIMENTO DA LEI, DA MORAL E DOS BONS COSTUMES OU DA ORDEM PÚBLICA GERALMENTE ACEITADAS COMO RESULTADO DA PRESTAÇÃO DE SERVIÇOS POR TERCEIROS ATRAVÉS DO PORTAL; (B) VIOLAÇÃO DE DIREITOS DE PROPIEDADE INTELECTUAL E INDUSTRIAL, SEGREDOS COMERCIAIS, COMPROMISSOS CONTRATUAIS DE QUALQUER NATUREZA, DIREITOS DE HONRA, PRIVACIDADE PESSOAL E FAMILIAR E IMAGEM DE PESSOAS, DIREITOS DE PROPRIEDADE E QUALQUER OUTRA NATUREZA PERTENCENTES A TERCEIROS COMO RESULTADO DA PRESTAÇÃO DE SERVIÇOS POR TERCEIROS ATRAVÉS DO PORTAL; (C) A REALIZAÇÃO DE ATOS DE CONCORRÊNCIA DESLEAL E PUBLICIDADE ILÍCITA COMO RESULTADO DA PRESTAÇÃO DE SERVIÇOS POR TERCEIROS ATRAVÉS DO PORTAL; (D) A FALTA DE VERACIDADE, EXATIDÃO, INTEGRIDADE, RELEVÂNCIA E/OU ATUALIDADE DOS CONTEÚDOS TRANSMITIDOS, DIFUNDIDOS, ARMAZENADOS, RECEBIDOS, OBTIDOS, DISPONIBILIZADOS OU ACESSÍVEIS ATRAVÉS DOS SERVIÇOS PRESTADOS POR TERCEIROS ATRAVÉS DO PORTAL; (E) A INADEQUAÇÃO PARA QUALQUER TIPO DE FINALIDADE E A DEFRAUDAÇÃO DAS EXPECTATIVAS GERADAS PELOS SERVIÇOS PRESTADOS POR TERCEIROS ATRAVÉS DO PORTAL; (F) O NÃO CUMPRIMENTO, ATRASO NO CUMPRIMENTO, CUMPRIMENTO DEFEITUOSO OU RESCISÃO POR QUALQUER MOTIVO DE OBRIGAÇÕES CONTRAÍDAS POR TERCEIROS E CONTRATOS FEITOS COM TERCEIROS EM RELAÇÃO OU EM CONEXÃO COM A PRESTAÇÃO DE SERVIÇOS ATRAVÉS DO PORTAL; (G) OS VÍCIOS E DEFEITOS DE TODOS OS TIPOS DE SERVIÇOS PRESTADOS POR TERCEIROS ATRAVÉS DO PORTAL.

6.1.6. EXCLUSÃO DE GARANTIAS E RESPONSABILIDADE POR SERVIÇOS E CONTEÚDOS HOSPEDADOS FORA DO PORTAL

O Portal disponibiliza aos Usuários dispositivos técnicos de link (tais como, entre outros, links, banners, botões), diretórios e ferramentas de busca que permitem aos Usuários acessar sites pertencentes e/ou administrados por terceiros (doravante denominados «Sites Ligados»). A instalação desses links, diretórios e ferramentas de busca no Portal tem como única finalidade facilitar a busca e o acesso dos Usuários às informações disponíveis na Internet.

A IFUNDTRADERS não oferece nem comercializa, por si ou através de terceiros, os produtos e serviços disponíveis nos Sites Ligados. A IFUNDTRADERS também não controla, aprova, monitora ou realiza previamente os produtos e serviços, conteúdos, informações, dados, arquivos, produtos e qualquer tipo de material existente nos Sites Ligados. O Usuário, portanto, deve ter extremo cuidado na avaliação e utilização dos serviços, informações, dados, arquivos, produtos e qualquer tipo de material existente nos Sites Ligados.

A IFUNDTRADERS NÃO GARANTE NEM ASSUME QUALQUER TIPO DE RESPONSABILIDADE POR DANOS DE QUALQUER NATUREZA QUE POSSAM DEVER-SE (A) AO FUNCIONAMENTO, DISPONIBILIDADE, ACESSIBILIDADE OU CONTINUIDADE DOS SITES LIGADOS; (B) À MANUTENÇÃO DOS SERVIÇOS, CONTEÚDOS, INFORMAÇÕES, DADOS, ARQUIVOS, PRODUTOS E QUALQUER TIPO DE MATERIAL EXISTENTE NOS SITES LIGADOS; (C) A PRESTAÇÃO OU TRANSMISSÃO DE SERVIÇOS, CONTEÚDOS, INFORMAÇÕES, DADOS, ARQUIVOS, PRODUTOS E QUALQUER TIPO DE MATERIAL EXISTENTE NOS SITES VINCULADOS; (D) A QUALIDADE, LEGALIDADE, CONFIABILIDADE E UTILIDADE DOS SERVIÇOS, CONTEÚDOS, INFORMAÇÕES, DADOS, ARQUIVOS, PRODUTOS E QUALQUER TIPO DE MATERIAL EXISTENTE NOS SITES VINCULADOS, NOS MESMOS TERMOS E COM O MESMO ALCANCE PREVISTOS NA CONDIÇÃO GERAL 0 E 0 EM RELAÇÃO AOS CONTEÚDOS E SERVIÇOS FORNECIDOS POR TERCEIROS ATRAVÉS DO PORTAL.

6.1.7. EXCLUSÃO DE GARANTIAS E RESPONSABILIDADE PELA UTILIZAÇÃO DO PORTAL, SERVIÇOS E CONTEÚDOS PELOS USUÁRIOS

A IFUNDTRADERS não tem nenhuma obrigação e não controla o uso que os Usuários fazem do Portal, dos Serviços e dos Conteúdos. Em particular, a IFUNDTRADERS não garante que os Usuários utilizarão o Portal, os Serviços e os Conteúdos de acordo com as presentes Condições Gerais e, se for o caso, as Condições Particulares que resultem da sua aplicação, nem que o farão de forma diligente e prudente. A IFUNDTRADERS também não está obrigada a verificar e não verifica a identidade dos Usuários, nem a veracidade, validade, integridade e/ou autenticidade dos dados que os Usuários fornecem sobre si mesmos a outros Usuários.

A IFUNDTRADERS EXCLUI QUALQUER RESPONSABILIDADE POR DANOS DE QUALQUER NATUREZA QUE POSSAM DEVER-SE À UTILIZAÇÃO DOS SERVIÇOS E CONTEÚDOS PELOS USUÁRIOS OU QUE POSSAM DEVER-SE À FALTA DE VERACIDADE, VALIDADE, INTEGRALIDADE E/OU AUTENTICIDADE DAS INFORMAÇÕES QUE OS USUÁRIOS FORNECEM AOS OUTROS USUÁRIOS SOBRE SI PRÓPRIOS E, EM PARTICULAR, EMBORA NÃO EXCLUSIVAMENTE, POR DANOS DE QUALQUER NATUREZA QUE POSSAM DEVER-SE À IMITAÇÃO DE UM TERCEIRO FEITO POR UM USUÁRIO EM QUALQUER TIPO DE COMUNICAÇÃO EFECTUADA ATRAVÉS DO PORTAL.

7.NO LICENÇA

A IFUNDTRADERS não concede qualquer licença ou autorização de utilização de qualquer tipo sobre os seus direitos de propriedade industrial e intelectual ou sobre qualquer outra propriedade ou direito relacionado com o Portal, os Serviços ou os Conteúdos.

8.NEGAÇÃO E RETIRADA DE ACESSO AO PORTAL E/OU SERVIÇOS

A IFUNDTRADERS reserva-se o direito de recusar ou retirar o acesso ao Portal e/ou aos Serviços em qualquer momento e sem aviso prévio aos Usuários que não cumpram as presentes Condições Gerais ou as Condições Particulares aplicáveis.

9.DURAÇÃO E TERMINAÇÃO

A prestação do serviço do Portal e dos demais Serviços tem, em princípio, uma duração indeterminada. A IFUNDTRADERS, no entanto, está autorizada a encerrar ou suspender a prestação do serviço do Portal e/ou de qualquer um dos Serviços a qualquer momento, sem prejuízo do disposto a este respeito nas Condições Particulares pertinentes. Quando seja razoavelmente possível, a IFUNDTRADERS deverá comunicar previamente a cessação ou suspensão da prestação do serviço do Portal e de outros Serviços.
